The presiding judge, Justice Abdulaziz Anka, dismissed the objections of Emmanuel Eze, counsel for the Inspector-General of police and the Nigeria Police Force.
The Federal High Court Sitting in Lagos on Wednesday, August 16, says the fundamental rights enforcement suit filed by alleged kidnap kingpin Chukwudumeme Onwuamadike, popularly known as Evans can proceed.
He had filed the suit against the Inspector General of Police, Ibrahim Idris, the Nigeria Police Force, as the third and fourth respondents.
The other respondents are the Lagos State Police Commissioner and the Special Anti-Robbery Squad.
The presiding judge, Justice Abdulaziz Anka, dismissed the objections of Emmanuel Eze, counsel for the IG and the Nigeria Police, and agreed with Evans' lawyer, Olukoya Ogungbeje, that service on the third and fourth respondents has been properly effected.

In his ruling, Justice Anka also held that leave was not required for the matter to be heard during vacation, as Order 4 Rule 5 of the Fundamental Rights Enforcement Procedure Rules of 2009 enjoins the court to pursue speed and justice on issues of fundamental human rights.
