The accused was still nursing a grudge against the deceased whom he accused of taking part of his suya.

The Ebute Meta Chief Magistrates' Court in Lagos on Monday ordered that Abiodun Taiwo, 46, charged with killing his friend over grilled meat, a.k.a 'Suya', be remanded in Ikoyi Prisons custody.

The chief magistrate, Mrs Oluyemisi Adelaja, who gave the order, refused to take the plea of the accused saying the charge preferred against him was a capital offence.

Adelaja said that the court would require legal advice from the Director of Public Prosecutions (DPPs) before it could proceed on the case.

"The accused is hereby ordered to be remanded at the Ikoyi Prisons, pending legal advice from the DPP. The case file should also be duplicated and forwarded to them,’’ she said.

Earlier, the prosecutor, Sgt. Simon Njue, had told t court that the accused, whose address was not disclosed, committed the offence on March 4.

The accused is facing a charge of attempted murder.
Njue said the accused committed the charge leveled against him at 2.30 a.m., in front of the African Shrine in Agidingbi, Ikeja.

The prosecutor said the accused pushed the deceased as well as his friend, Ayodeji Ogunleye, because the later (Ogunleye) had taken out of the `suya’ belonging to the former.

"The accused was still nursing a grudge against the deceased whom he accused of taking part of his suya.

"The accused angered by Ogunleye’s action pushed the latter, who in the process, fell and hit his head on the floor," he said.

The offence, according to the prosecutor, contravenes Section 221 of the Criminal Law of Lagos State, 2011.

The News Agency of Nigeria (NAN) reports that Section 221 prescribes life imprisonment for offenders.

The court adjourned the case till June 1, when it would have received the legal advice from the DPPs.
