A Karu Grade 1 Area Court, Abuja, on Tuesday discharged one Alhaji Bashir, 26, for lack of sufficient evidence in the three-court charge bordering on joint act, shop breaking and theft levelled against him.
The judge, Mr Hassan Ishaq said since the case began Dec. 28, 2016, only the complainant, Lucky Hilo, testified in the matter.
He also said that no exhibit was tendered, while the prosecutor, Mr Mahmud Ismai’la, did not call another witness.
“ Since the matter began on December, 2016, only one witness, Lucky Hilo, testified and no exhibit was tendered before the court."
“ Going through the evidence of the witness, it was revealed that the witness was not present at the scene of the crime."
“ The witness gave his testimony based on what he was told by his neighbours."
“ The defendant was only arrested by the police based on intelligence reports, so no sufficient evidence was presented in court against the defendant; therefore, there is no prima facie case.
The defendant who spoke with the News Agency of Nigeria (NAN), said the end of the case was a great relief to him.
“ I was granted bail, but I could not get anyone to stand for me as surety, so I have been in prison custody since then, but today I am relieved and I am grateful to God,’’ Bashir said.
The court granted him a bail of N 50, 000, with a surety in like sum, after he pleaded not guilty to the charges.
