In Lagos: Trader,30, in court over N100,000 fraud

The prosecutor said the accused did not give any motorcycle to the complainant and also refused to refund his money when asked to do so.

A 30-year-old trader, Tizhe Fashe, on Wednesday appeared in an Apapa Magistrates’ Court, Lagos, for allegedly obtaining N100,000 from one Haruna Hayu on the pretext of selling a motorcycle to him.

Fashe, who lives in Festac Town, Lagos, is facing a three-count charge of conspiracy, stealing and obtaining under false pretences.

The Prosecutor, Sgt. Olusegun Kokoye, told the court that the accused committed the offences on April 27, at Agboju 2nd Gate, Festac Town, Lagos.

Kokoye said the accused with others now at large, fraudulently obtained N100,000 from Hayu with a promise to sell a motorcycle to him.

He said that the accused, who had no intention of selling any motorcycle to the complainant, converted the money to his own personal use.

The prosecutor said the accused did not give any motorcycle to the complainant and also refused to refund his money when asked to do so.

Kokoye said that Hayu reported the matter to the police and Fashe was arrested.

He said the offences contravened Sections 285, 312 and 409 of the Criminal Law of Lagos State, 2011.

The News Agency of Nigeria (NAN) reports that Section 312 stipulates 15-year jail term for obtaining by false pretences.

The accused, however, pleaded not guilty.

The Magistrate, Mr M.A Etti, granted the accused N100,000 bail with one surety in like sum.

He said the surety must be gainfully employed and show evidence of two years’ tax payment to the Lagos State Government.

Etti adjourned the case till May 30 for mention.
